California Laws Protecting Immigrant Workers

- Labor Code 90.2 requires employers give notice to employees within 72 hours of immigration enforcement actions, & results of I-9 verification
- Labor Code 1019, 1019.2 prohibit unfair immigration-related practices like I-9 re-verification when not legally required, requiring more or different documents than I-9 list, or retaliation for protected activities, loss of business license, $10k penalty
- Labor Code 98.6, 1102.5 prohibit retaliation for protected activities
- Penal Code 519 criminal extortion includes threat to report immigration status
- Evidence Code 351.3 requiring in camera review before immigration status can be disclosed in open court
